MyDubaiPRO.com is a platform that aggregates different services from service providers (collectively, "Service Providers“) that are registered with the necessary licensing or regulatory bodies for services. Services are booked through the website or the mobile application and delivered directly to the customer by the Service Providers.

These terms and conditions ("Agreement") regulate your use of the MyDubaiPRO.com website ("Website"), "MyDubaiPRO" mobile application ("Mobile Application"), and any of their associated products and Services (collectively, "Services"). This Agreement is legally binding between you (“User”, “you” and “your”) and My PRO PORTAL LLC (“MyPRO”, "MyPRO LLC", “we”, “us” or “our”). The terms "User," "you," or "your" relate to the entity in question if you are signing this Agreement on behalf of a company or other legal entity and you represent that you are authorized to bind that entity to its terms.

You must not accept this Agreement and may not access or use the Services if you do not have such authority or if you do not agree with the provisions of this Agreement. You acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement by accessing and using the Services. You accept that, despite the fact that this Agreement is electronic and not physically signed by you, it constitutes and governs your use of the Services in a contract between you and MyPRO.

Registration and Account Security

If you create an account on the Services, you are responsible for keeping your account secure and are entirely liable for any activities that occur under the account and any other actions done in connection with it. We may, but are under no obligation to, monitor and review new accounts before allowing you to sign in and use the Services.

False contact information of any sort may lead to the deletion of your account, our Services ceasing immediately, and we keeping any collected money as a contractual fine or requesting payments for prior purchases without having to provide any further Services.

Customers are encouraged to own an electronic device (like a smartphone, computer, or portable device) for registration on the MyPRO Website or through our Mobile Application that is for the best performance of the MyPRO App with a functional mobile number, the ability to read text messages (SMS), and the ability to receive push notifications from MyPRO (the device).

The customer must contact MyPRO as soon as possible if the device is lost or stolen in order to prevent access to the MyPRO platform through the device from being banned, suspended, or deactivated and to prevent further use of the device to access the platform. For the avoidance of doubt, MyPRO can only access the MyPRO platform from the device and cannot block, suspend, or deactivate itself.

You agree that MyPRO may monitor and/or record any conversations between you and our experts via the MyPRO Platform for the purposes of quality control, customer satisfaction, and other related goals.

Any unauthorized access to your account or any other security lapses must be reported to us right away. Any actions or inactions on your part, as well as any damages of any type resulting from such actions or inactions, are not our responsibility. If we find that you have broken any of the terms of this Agreement or that your behavior or material would likely harm our reputation and goodwill, we may suspend, deactivate, or delete your account (or any portion thereof). If we deactivate your account for any of the reasons stated above, you may not re-register for our Services either directly or via a third party. To prevent subsequent registration, we may ban your email ID and Internet Protocol (IP) address.

Service Requests

  1. MyDubaiPRO connects customers seeking Services and professionals providing such Services sought by the customer.
  2. Customers can submit a request for Professional Service through the Website. After a Service Request is submitted, MyPRO will direct it to the appropriate experts depending on their availability and location. MyPRO is the sole determiner of processes. The Service Request may be accepted based on professional availability for the specified location at the time of the request. Your request is subject to approval by a professional. MyPRO will notify the customer by SMS, push notification, or confirmation screen, as well as the MyPRO Mobile Application or Website, after a professional has accepted the Service Request. MyPRO will inform the customer in the same manner if no professional is able to accept the Service Request.
  3. The Services provided through the platform include: Accepting Service Requests subject to the terms herein, Identifying professionals to provide professional Services, Receiving and dealing with feedback questions and complaints related to Service Request, Remotely monitoring the start and end of Service Request using the MyPRO Platform, Offering customer support for grievances in each situation in compliance with any applicable legal regulations.
  4. Once a Service Request has been accepted MyPRO may provide the customer with a confirmation through the MyPRO application and information regarding the professional (including the contact number, a picture of the professional, and any other details you see considers appropriate); and the professional with customer details such as Service purchased and any further information provided by the customer to fulfill the order.
  5. The customer understood that the acceptance and fulfillment of a Service Request will result in an independent professional Services contract between the professional and the customer after the Service Request has been assigned to the professional on the MyPRO  application as previously indicated. The customer consents that after accepting the Service Request, MyPRO may give the professional the customer's mobile phone number, rating, and other information to improve and facilitate the professional's direct delivery of professional Services to the customer and to help the professional identify the customer.
  6. When a Service Request is assigned to a professional, MyPRO will give the professional the pertinent customer information so that they may offer the professional Services to the customer directly.
  7. If the customer needs to cancel an assigned Service Request, the customer must immediately contact MyPRO customer support or may cancel and assign Service Request through the MyPRO application in the event of a cancellation.
  8. If you have given your approval to receive the below, MyPRO or its authorized agent will send you information about MyPRO Services, discounts, and promotions via SMS, E-mail, Mail, or WhatsApp to your provided mobile number, address, or email ID. You are given the choice to stop receiving those updates at any time. To discontinue receiving such information you may at any point in time contact our support team.

Accuracy of information

On occasion, there could be information on the Services that is inaccurate, incomplete, or missing information that relates to product descriptions, prices, promotions, and offers.

We retain the right to modify or update information or cancel orders if any information on the Services or Services is erroneous at any time without prior notice in order to remedy any mistakes, inaccuracies, or omissions (including after you have submitted your order). Unless as required by, we make no commitment to update, modify, or make clear anything on the Services, including without limitation price information. It should not be assumed that since there is no explicit update or refresh date assigned to the Services, all information on the Services or Services has not been changed or updated.

User Information

Any information, data, or materials (collectively, "Content") that you upload on the Services while using the Service are not our property. All submitted Content is subject to your entire responsibility for its truthfulness, integrity, appropriateness, legality, and intellectual property ownership or right to use. When you submit content to the Services or develop it using our Services, we may watch over it and assess it. In order to provide you with the Services, you give us permission to access, copy, distribute, store, transmit, reformat, display, and perform the Content of your user account. We reserve the right, however no obligation, at our sole discretion, to reject or take down any Content that, in our reasonable judgment, violates any of our policies or is otherwise harmful or objectionable. This applies without limiting any of the aforementioned representations or warranties. You also grant us the irrevocable license to use, reproduce, adapt, modify, publish or distribute the content created by you or stored in your user account for commercial, marketing or any similar purpose. Upon the customer's reasonable request, MyPRO  may supply the customer with personal information about experts who agreed to provide a professional Service to the customer. The customer guarantees that such professional's data will not be used for any other purposes, including but not limited to marketing or bypassing MyPRO, and that it will:

  1. Only use such personal information as necessary to obtain the products or Services, comply with applicable laws, and ensure that such professional's data will not be used;
  2. Not disclose, rent, sell, or otherwise provide such information to third parties without MyPRO and the Professionals' prior written consent.
  3. In order to protect the security, integrity, and confidentiality of the MyPRO and Professional's information that it receives from MyPRO, the customer agrees to take reasonable and appropriate administrative, physical, and technical measures; promptly notify MyPRO of any data breaches or other information security events; and refrain from claiming that it receives Services from MyPRO if its account with MyPRO is inactive or terminated.

Customer and service provider disagreements

  1. If MyPRO tries to ease the resolution of any customer complaint or dispute between the customer and a professional in regard to a Service Request, the customer will comply with MyPRO.
  2. Under no circumstances is MyPRO responsible to the customer or anyone else for the settlement (or lack thereof) of any such situation. The customer agrees to reimburse MyPRO for any such payments as well as any costs, expenses, or attorney fees that MyPRO incurs in connection with such dispute. MyPRO reserves the right to charge the customer for any amounts MyPRO pays to professionals in connection with any such disputes or complaints, including disputes regarding the customer's conductor misrepresentation.
  3. The customer acknowledges that MyPRO has the right to provide any information it has about the customer to any authorities who ask for it in relation to a product or Service or to tell the customer of any information they have.

Backups

We shall make every effort to guarantee the accuracy and completeness of the backups we make of the Website and its Content on a regular basis. We will automatically restore backups in the case of hardware failure or data loss to lessen the effects of downtime.

Referral to third party Document Clearance Service Providers

By using our Website or application, you accept that we will connect you or refer you to third party Services Providers that specialize in delivering your requested Service. When this occurs, we function as an intermediary between you and the third-party provider. The Service Provider is and will continue to be an independent contractor for the provision of the Services. Nothing in this Agreement shall be considered to form an association, trust, partnership, joint venture, or other commercial entity between us and the Service Provider, or to impose any trust or partnership or similar responsibility on any Party.

Prohibited uses

These Terms and conditions prohibit you from using the Services or our Website/Mobile Application:

  1. for any illegal activity;
  2. to solicit others to perform or participate in any unlawful acts;
  3. to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances;
  4. to infringe upon or violate our intellectual property rights or the intellectual property rights of others;
  5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability;
  6. to submit incorrect or misleading information;
  7. to upload or transmit viruses or any other type of malicious code that will or maybe used in any way that will affect the functionality or operation of the Services, third party products and Services, or the Internet;
  8. to spam, phish, pharm, pretext, spider, crawl, or scrape;
  9. for any obscene or immoral purpose;
  10. to solicit others or perform or participate in any violations of Embargo, AML, OFAC and sanction laws;
  11. to interfere with or circumvent the security features of the Services, third party products and Services, or the Internet;

We reserve the right to terminate your use of the Services for violating any of the prohibited uses and might take legal actions against you.

Intellectual property rights

“Intellectual Property Rights'' refers all present and future rights conferred by statute, common law or equity in or in connection to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world. These terms and conditions do not shift any intellectual property owned by MyPRO or third parties to you, and all rights, titles, and interests in and to such property will remain entirely with MyPRO (as between the parties).All trademarks, Service marks, designs, and logos used in conjunction with the Services are trademarks or registered trademarks of their respective owner MyPRO or third parties. You have no right or permission to duplicate or use any MyPRO or third-party trademarks under any circumstances.

Disclaimer of Warranty

You understood that the Services are offered "as is" and "as available" so utilizing them is totally at your own risk. Excluding but not limited to the implicit claims of merchantability, suitability for a specific purpose, and non-infringement. We explicitly disclaim any warranties of any kind, whether express or implied. We do not guarantee that the Services will satisfy your needs or that they will be timely, secure, uninterrupted, or error-free. We also do not guarantee the outcomes of using the Service, the validity or accuracy of any data gained through the Service, or the removal of any defects in the Service. You understand and accept that any content and/or information you download or gain through the use of the Service is done at your own risk, and that you alone are liable for any damage to your software system or loss of data resulting from such downloads. Except as expressly indicated otherwise, we provide no warranties for any products orServices that are ordered or received via the Service. There are no warranties implied by any advice or information, whether oral or written, that you may have acquired from us or via the Service.

Sales and Payments

You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable to MyPRO. In order to provide Users with the most secure environment possible, sensitive and confidential data transmission occurs via an SSL secured communication channel, is encrypted, and protected with digital signatures. Moreover, the Services are compliant with PCI vulnerability requirements. For further security and protection, we may conduct malware scans on a regular basis. We reserve the right to add, delete, or alter items and their prices, as well as the right to reject any order you place with us. We have the right to restrict or discontinue sales to any individual, household, or order at our sole discretion. These limitations may apply to orders made using the same credit card, the same billing address, the same shipping address, or orders made by or under the same customer account. If your purchase is modified or canceled, we may attempt to reach you by phone, email, and/or the billing address/phone number you provided when placing the transaction.

Third party services

If you decide to enable, access or use third party Services (such as for authentication),be advised that your access and use of such other Services are governed solely by the terms and conditions of such other Services, and we do not endorse, are not responsible or liable for, and make no representations as to any aspect of such other Services, including, without limitation, their content or the manner in which they handle data (including your data) or any interaction between you and the provider of such other Services. You irrevocably waive any claim against MyPRO with respect to such other Services. MyPRO is not responsible for any loss or damage caused or purported to be caused by or in relation to your activating, accessing, or using any other Services, or your dependence on such other Services' privacy practices, data security processes, or other policies. Such other Services may need you to sign up for or register onto their separate platforms. By enabling any other Services, you fully consent to MyPRO, disclosing your data as needed to allow the usage or enablement of such other Service.

The Services may link to other resources (such as websites, Mobile Applications, etc.), and we are not, in any way, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically mentioned herein. We have no obligation to investigate, assess, or guarantee the accuracy of any company's or person's information, product, Service, or another offer. We disclaim all duty and responsibility for any such third parties conduct, goods, Services, and content. Whenever you access a source through a link on the Services, you should carefully check the legal disclaimers and other terms of use.   You link to any other off-site content at your own risk.

Liability

To the fullest extent permitted by applicable law, in no event will MyPRO, its affiliates, directors, officers, employees, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of MyPRO and its affiliates, officers, employees, agents, suppliers and licensors relating to the Services will be limited to the amount actually paid by you to MyPRO for the one-month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.

Indemnification

You agree to indemnify and hold MyPRO and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Services or any willful misconduct on your part.

Severability

All rights and limitations set forth in this Agreement may only be imposed and shall be applicable and binding insofar as they do not conflict with any laws that may be in force. They are also intended to be limited to the minimum extent necessary to avoid making this Agreement illegal, invalid, or unenforceable. It is the intention of the parties that the remaining provisions or portions thereof shall constitute their Agreement with respect to the subject matter hereof and that all such remaining provisions or portions there of shall remain in full force and effect if any provision or portion of any provision of this Agreement shall be held to be illegal, invalid, or unenforceable by a court of competent jurisdiction.

Assignment

Without our prior written consent, which we may withhold in our sole discretion and without obligation, you are not permitted to assign, resell, sublicense, transfer, or otherwise delegate any of your rights or obligations under this Agreement, in whole or in part. Any such assignment or transfer is void. As part of the sale of all or nearly all of its assets or stock, or as a component of a merger, we are free to assign any of its rights or responsibilities under this Agreement, in whole or in part, to any third party.

Updates and amendments

We retain the right, in our sole discretion, to change this Agreement or any of its provisions pertaining to the Services at any time. We will update the date at the bottom of this page when we do so. At our discretion, we may also notify you in other ways, such as using the contact details you have supplied.

Unless otherwise stated, a new version of this Agreement will take effect as soon as it is posted online. Your continued use of the Services following the updated Agreement's effective date (or any other action indicated at that time)will be regarded as your acceptance of those changes.

Dispute resolution

The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of the United Arab Emirates without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of the United Arab Emirates. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in the United Arab Emirates, and you hereby submit to the personal jurisdiction of such courts.

The time it takes MyDubaiPRO to answer to such a request might be up to 7 (seven) business days.

Opting-out of Marketing and Promotional Communications We try our best to give you the option to opt out of receiving marketing and promotional emails from us by including an unsubscribe link in each email that you get from us. You are aware of this and agree that it can take us upto 10 (Ten) business days to implement your request to opt out. Please be aware that we may continue sending you emails regarding your user account or any services that you have requested or received from us.


6.       YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA

a. We gather several kinds of personal information about you. This comprises, but is not restricted to:

i. Personal Information, such as your Email ID or home address, location, mobile numbers, your name, username or similar identifiers, photographs, and gender.

ii. Usage Data, which consists of data on how you use the Services and Professional Services, your online activity, booking history, user taps and clicks, user interests, time spent on the Platform, information on user journey on the mobile application, and page views.

iii. Technical Data, which includes your IP address, browser type, internet service provider, details of operating system, access time, page views, device ID, device type, frequency of visiting our website and use of the Platform, website and mobile application activity, clicks, date and time stamps, location data, and other technology on the devices that you use to access the Platform.

iv. Marketing and Communications Data, such as your address, email address, information posted in service requests, offers, wants, feedback, comments, pictures and discussions in our blog and chat boxes, responses to user surveys and polls, your preferences in receiving marketing communications from us and our third parties, and your communication preferences. When you contact with support experts via the Platform, we also collect your chat and phone data.

The processing of your request by MyDubaiPRO might take up to 7 (seven) business days. You won't have access to any Services if your account is deactivated.
